Our aims are to set forth a multiprinciple system for selecting among clinical trials competing for limited space in an immunotherapy production facility that supplies products under investigation by scientific investigators; defend this system by appealing to justice principles; and illustrate our proposal by showing how it might be implemented. Our overarching aim is to assist manufacturers of immunotherapeutic products and other potentially breakthrough experimental therapies with the ethical task of prioritizing requests from scientific investigators when production capacity is limited.

No consensus yet exists on how to handle incidental fnd-ings in human subjects research. Yet empirical studies document IFs in a wide range of research studies, where IFs are fndings beyond the aims of the study that are of potential health or reproductive importance to the individual research participant. This paper reports recommendations of a two-year project group funded by NIH to study how to manage IFs in genetic and genomic research, as well as imaging research. We conclude that researchers (...) have an obligation to address the possibility of discovering IFs in their protocol and communications with the IRB, and in their consent forms and communications with research participants. Researchers should establish a pathway for handling IFs and communicate that to the IRB and research participants. We recommend a pathway and categorize IFs into those that must be disclosed to research participants, those that may be disclosed, and those that should not be disclosed. (shrink)

The title of this interesting study may be misleading; Crocker's subject is not Rousseau's or Hegel's conception of liberty considered in contradistinction to, say, Locke's or J. S. Mill's. The philosophy of Positive Liberty is strictly English-speaking and its intention is to argue against those within the Lockean tradition who would claim that personal liberty can only be limited by deliberate human action. Crocker is in full agreement with his opponents in holding that passion or irrationality is in no way (...) an obstacle to liberty, but he wants to persuade negative libertarians that disabilities like poverty, powerlessness, physical handicap, and manipulative information management are conditions as seriously preventive of liberty as are forcible coercion and legal prohibition. His argument is that increasing liberty requires maximizing the range and desirability of opportunities and choices rather than simply minimizing deliberate or overt restraint. The consequence for political philosophy of this position, which Crocker calls left-libertarian, is that a social commitment to personal liberty may require extensive and costly positive redistributive policies. According to Crocker, positive liberty is not a new conception of liberty, but rather a novel and more inclusive sense of the obstacles to freedom: "the emphasis shifts from the constraints to the alternatives and such matters as their range and desirability. The absence of interference by other persons appears as but one feature of liberty among several". (shrink)

Della Volpe was a professor of philosophy, one of the leading theoreticians of the Italian Communist Party in the 50s and 60s, and one of the few prominent intellectuals to retain party membership following the Hungarian revolt. Nonetheless, his Marxism is distinctly heterodox. The main thrust of Rousseau and Marx, which contains an essay of that name as well as several short papers on Soviet legality and "materialist methodology," is to establish certain continuities between Marx’s thought and earlier philosophy. Marx (...) is here depicted as attempting to solve a problem first stated by Rousseau, the problem of egalitarian liberty, and as applying the logic of modern experimental science to moral and political questions. Fishkin defines tyranny as all acts of public policy which impose severe deprivations upon individuals in circumstances in which such deprivations are avoidable. His argument is that "virtually all of the principles currently prominent in political theory" will in some instances support or legitimate policies which tend to tyranny understood in this way. However, his parochial conception of what counts as currently prominent political theory makes his indictment considerably less universal than he apparently takes it to be. The style, questions, (...) and sources for the book are drawn entirely from the works of the liberal or public choice school in political philosophy. Fishkin’s critique is thus directed only at the kinds of principles developed by writers like Rawls, Nozick, and Buchanan and Tullock; but precisely because it is so wholly within the tradition it criticizes, the book provides a challenge to that tradition which manages to be both fundamental and free from tendentiousness. Popper proposes a technical concept of 'verisimilitude' as a test of the progressiveness of scientific theories. The paper attempts to show its uselessness and inapplicability on mathematical and practical grounds, As well as raising doubts about the value of any such attempt to give a mechanical test of scientific progress.

The purpose of Donald Winch’s "historiographic revision" is to show that most recent interpretations of Smith have distorted his meaning because they have misread the intention of Smith’s work, treating it either as the first great justification of the nascent liberal capitalist polity, or as such a justification infiltrated by intimations of the Marxian notion of alienation. In Winch’s view, either account of Smith’s project is misleading by virtue of imposing nineteenth-century perspectives and categories upon "what is quintessentially a work (...) of the eighteenth century." The problem, then, is to determine the historically appropriate context or problematic within which the complex and at times paradoxical thought of the Wealth of Nations, the Theory of Moral Sentiments, and the Lectures on Jurisprudence can reasonably be situated. As Winch notes, his study is an application of the contextualist methodological principles of Quentin Skinner and J. G. A. Pocock, and is similar in design to recent works on Locke by John Dunn and on Hume by Duncan Forbes. (shrink)

This article presents a set of moral arguments regarding the selective abortion of fetuses on the basis of prenatal screening for late onset genetic diseases only, and for Huntington's Disease* in particular. After discussion of human suffering, human perfection and the distinctive features of the lives of people confronting late onset genetic disease, the author concludes that selective abortion is difficult to justify ethically, although it must remain a matter of personal choice.

The work is aimed at interpreting text and paintings in D. Rubina and B. Karafelov’s book ‘Okna‘. The authors of the article conduct an analysis of episodes with pictorial ecphrasis in the stories from the book and an iconographic analysis of paintings inside the stories. The chosen topic is actual, because it provides an alternative way to solve a problem of word and image relations in the text. The article is aimed at the search for new methods to reflect a (...) protagonist’s character. In this context, the authors of the article compare images in D. Rubina’s texts with B. Karafelov’s paintings, analyze the symbiotical connection of pictorial ecphrasis and reproductions of paintings. The most of the stories are autobiographical what makes them representative in terms of transferring the narrator’s position through the pictorial ecphrasis. In that book, paintings are not just illustrations and not visualization of ecphrasis. Pictures were introduced into the text of novels for presenting main motives and enriching stories by new images and meanings, which could not be represented by text. Colors of paintings are accentuated by color-designation words and are converged to tonality of text. Thereby a reader can interact with a writer and a painter simultaneously. After analyzing of text and pictures, the authors of the article made a conclusion about efficiency of word and picture synthesis for disclosure of the same themes in multiple artistic planes. Jewish German philosopher Ernst Cassirer was a leading proponent of the Marburg school of neo-Kantianism. The essays in this volume provide a window into Cassirer’s discovery of the symbolic nature of human existence—that our entire emotional and intellectual life is configured and formed through the originary expressive power of word and image, that it is in and through the symbolic cultural systems of language, art, myth, religion, science, and technology that human life realizes itself and attains not only its form, (...) its visibility, but also its reality. Thought and being are set in opposition and united in genuine correspondence by the symbolic strife between them that Cassirer calls _Auseinandersetzung,_ which determines the ethical relationship of the self to the other. Background: In Switzerland, non-medical right-to-die organisations such as Exit Deutsche Schweiz and Dignitas offer suicide assistance to members suffering from incurable diseases. Objectives: First, to determine whether differences exist between the members who received assistance in suicide from Exit Deutsche Schweiz and Dignitas. Second, to investigate whether the practices of Exit Deutsche Schweiz have changed since the 1990s. Methods: This study analysed all cases of assisted suicide facilitated by Exit Deutsche Schweiz (E) and Dignitas (D) between 2001 and 2004 and (...) investigated by the University of Zurich’s Institute of Legal Medicine (E: n = 147; D: n = 274, total: 421). Furthermore, data from the Exit Deutsche Schweiz study which investigated all cases of assisted suicide during the period 1990–2000 (n = 149) were compared with the data of the present study. Results: More women than men were assisted in both organisations (D: 64%; E: 65%). Dignitas provided more assistance to non-residents (D: 91%; E: 3%; p = 0.000), younger persons (mean age in years (SD): D: 64.5 (14.1); E: 76.6 (13.3); p = 0.001), and people suffering from fatal diseases such as multiple sclerosis and amyotrophic lateral sclerosis (D: 79%; E: 67%; p = 0.013). Lethal medications were more often taken orally in cases assisted by Dignitas (D: 91%; E: 76%; p = 0.000). The number of women and the proportion of older people suffering from non-fatal diseases among suicides assisted by Exit Deutsche Schweiz has increased since the 1990s (women: 52% to 65%, p = 0.031; mean age in years (SD): 69.3 (17.0) to 76.9 (13.3), p = 0.000), non-fatal diseases: 22% to 34%, p = 0.026). Conclusions: Weariness of life rather than a fatal or hopeless medical condition may be a more common reason for older members of Exit Deutsche Schweiz to commit suicide. The strong over-representation of women in both Exit Deutsche Schweiz and Dignitas suicides is an important phenomenon so far largely overlooked and in need of further study. (shrink)
